Regulatory Regime for Foreign Lawyers in Hong Kong


Hong Kong has a relatively closed approach to foreign legal practice, with restrictions on the scope of work and the establishment of permanent offices, limiting their ability to practice independently and restricting their scope of work. 


Key Restrictions:


  • Limited Scope of Practice: Foreign lawyers can only practice their home or third country law on a temporary basis. They cannot give advice on Hong Kong law or represent clients in Hong Kong courts unless they are admitted as solicitors or barristers in Hong Kong.

  • No Permanent Offices: Foreign lawyers cannot establish permanent offices in Hong Kong. They must work within a registered foreign firm or a Hong Kong firm.

  • Supervision Requirements: Foreign lawyers with less than two years of post-qualification experience are generally required to be supervised by a qualified Hong Kong solicitor.

  • Risk Management Requirements: Foreign lawyers in Hong Kong law firms are subject to certain risk management requirements, such as professional indemnity insurance and compliance with relevant regulations.

Foreign lawyers can practice law in Hong Kong under certain conditions. They are generally subject to the Foreign Lawyers Practice Rules, which regulate their activities and scope of practice.
