Hong Kong ORSO Scheme Guide

The Occupational Retirement Schemes Ordinance (ORSO) (Chapter 426) is the legislation governing voluntary, employer-sponsored retirement schemes in Hong Kong. Enacted in 1993, it predates the Mandatory Provident Fund (MPF) system and remains a key tool for corporations aiming to attract and retain talent through flexible, highly customizable retirement benefits.

Below is an overview of the ORSO framework, its key features, and its relationship with the MPF system.

Core Characteristics of ORSO

ORSO schemes are distinct from the standardized MPF system due to their voluntary nature and high degree of flexibility.

  • Scheme Types:

    • Defined Contribution (DC): Benefits are based on the sum of employer/employee contributions and the associated investment returns.

    • Defined Benefit (DB): Benefits are predetermined by a formula, typically factoring in the employee's final salary and years of service.

  • Voluntary Nature: Unlike the MPF, which is mandatory for most employees, employers choose whether to establish an ORSO scheme, and participation rules are governed by the specific scheme’s trust deed.

  • Customization: Employers have significant latitude to design:

    • Contribution rates (which can exceed standard MPF levels).

    • Vesting schedules (incentivizing long-term retention).

    • Investment strategies (often broader than the limited options found in standard MPF funds).

  • Regulatory Oversight: While voluntary, ORSO schemes must be registered with or exempted by the Mandatory Provident Fund Schemes Authority (MPFA), which acts as the Registrar of Occupational Retirement Schemes.

MPF-Exempted ORSO Schemes

Some ORSO schemes hold an MPF Exemption Certificate. This allows employees to be exempt from participating in the mandatory MPF system.

  • Employee Choice: If an employer operates an MPF-exempted ORSO scheme, they are legally required to give new eligible employees a one-time, irrevocable choice to join either the ORSO scheme or a standard MPF scheme within the first 30 days of employment.

  • Minimum MPF Benefits (MMB): For employees who joined an ORSO scheme after the launch of the MPF system (December 1, 2000), their accrued benefits up to the amount of "Minimum MPF Benefits" are subject to the same preservation and portability requirements as the MPF.

Strategic Considerations for Employers

  • Talent Retention: The ability to offer "vesting scales"—where the portion of employer contributions an employee is entitled to increases with their length of service—is a primary driver for firms using ORSO.

  • Administrative Complexity: ORSO schemes are generally more complex and costly to administer than the MPF. They require rigorous compliance, periodic audits, and, in the case of DB schemes, actuarial valuations at least once every three years.

  • Tax Implications: Employer contributions to an approved ORSO scheme are typically tax-deductible up to a limit of 15% of the employee’s total remuneration.

This information is for general reference. Given the complex nature of trust deeds and regulatory requirements, you should consult with your firm's compliance team or a qualified tax professional when managing ORSO structures.

Navigating Retirement Benefits: A Guide to ORSO for Hong Kong Employers

Hong Kong ORSO Scheme Guide

In the competitive landscape of 2026, talent retention is a primary objective for growing firms in Hong Kong. While the Mandatory Provident Fund (MPF) serves as the baseline for retirement savings, forward-thinking employers are increasingly leveraging the Occupational Retirement Schemes Ordinance (ORSO) to offer more flexible, customized benefits that attract top-tier talent.

At Bestar HR Hong Kong, we simplify the complexity of balancing statutory MPF requirements with voluntary ORSO structures. This guide breaks down the essential compliance framework and strategic benefits of the ORSO system.

1. Understanding the Regulatory Framework: ORSO vs. MPF

The ORSO (Chapter 426) allows employers to establish voluntary retirement schemes that are distinct from the government-mandated MPF.

  • What is ORSO? It is a voluntary scheme regulated by the Mandatory Provident Fund Schemes Authority (MPFA). It provides a mechanism for employers to offer retirement benefits that can be tailored to specific company policies rather than the standardized MPF format.

  • Key Distinctions:

    • Flexibility: Unlike MPF’s fixed 5% contribution and limited investment options, ORSO schemes allow for customizable contribution rates, diverse investment strategies, and flexible vesting schedules (which can be a powerful tool for employee retention).

    • Withdrawal Terms: ORSO schemes can offer more varied withdrawal options than the restrictive MPF system, which typically locks funds until age 65.

    • MPF Exemption: Employers with an approved ORSO scheme may apply for MPF Exemption. If granted, eligible employees can choose to join the ORSO scheme in lieu of the standard MPF.

2. Compliance Requirements for Employers

Operating an ORSO scheme involves rigorous regulatory obligations. If you are considering or currently operating an ORSO scheme, ensure you are hitting these benchmarks:

  • Registration/Exemption: Every ORSO scheme must be registered with or exempted by the MPFA. New applications must be submitted within three months of the contract's inception.

  • Ongoing Governance: ORSO schemes require formal documentation, typically a Trust Deed and Rules, administered by a professional trustee.

  • Reporting: Schemes are subject to oversight, and non-compliance can lead to significant penalties, including fines up to HK$500,000 and potential imprisonment.

  • Employee Choice: For MPF-exempted schemes, you are legally required to provide new employees with a one-time, irrevocable 30-day window to choose between the ORSO scheme and a standard MPF fund.

Why look beyond the MPF?

  2. Tax Efficiency: Employer contributions to an approved ORSO scheme are generally tax-deductible up to 15% of the employee’s total remuneration, providing a clear financial upside for the company.
